Homewrecking...?
In my state of North Carolina, someone may be sued for "Alienation of Affection". If someone wrecks marriage, they may be sued for the income they would have hand from the marriage if the divorce had not occured.
Not many states have this, and I am not a lawyer. I don't think it would work if there was no divorce.
Reply:who called and told this other woman just what room and hospital your step dad was in..............that would be the first thing I would want answered, but as to your question, let your mum gt a good divorce lawyer Florida is a community property state and there is also another little law where her hubby has to support her for at least a year if need be, so your mother could retrain for a job without panicking about money.
regards and do not seek revenge, really is not worth it in the long run......been there done that.
Reply:Not likely. Your mother did not lose a thing and the "home-wrecker" did not take a thing. She needs to divorce him and move on. Leave vengeance out of the equation.
Reply:No, Florida would not here your case. Stuff happens in life that is not fair. Cheating is not illegal.
Reply:There are some states where you can accuse someone of "stealing the affections" of your spouse, but it's pretty antiquated, and even though the laws are on the books, it's pretty much never enforced anymore. (And that's aside from the fact that you can't really prove damages for something like marital infidelity.)
You can't rape the willing, and your mother, and you, both need to be concerned about where the blame lies -- on your step-father.
I'm sorry to hear that he's ill, but the bottom line is he has been cheating on your mother -- and suing the woman he happened to cheat on her with won't help anything. Your mother needs to get a divorce, and she needs emotional and spiritual support during a difficult time. She doesn't need to waste energy trying to sue someone for her husband's infidelity.
